Parental Rights

The US Supreme Court has handed down a significant decision in Mirabelli v. Bonda reaffirming parental rights [1][2].

California law had required that schools effectively mislead parents about their children’s gender presentation, withholding information from parents as to their children’s use of preferred pronouns at school.  California viewed such disclosure as “forced outing” – as if the state had a greater interest in the welfare of children than their own parents [3].

The US Supreme Court ruling upheld the constitutional rights of parents to freely exercise their religion and direct the upbringing and education of their children [4][5].

In a related decision, Regino v. Staley, the 9th Circuit Court of Appeals last year pointed out that although the right of parents to make decisions for their children is not unbounded, the inquiry in cases of substantive due process is “whether the asserted fundamental right is objectively, deeply rooted in this Nation’s history and tradition, and implicit in the concept of ordered liberty, such that neither liberty nor justice would exist if it was sacrificed [6].”

The existence of the family could hardly be more fundamental, and long predated the existence of the state.

Biblical View

The Bible contains a wealth of verses addressing the responsibilities of parents.  Two that have bearing here are, as follows:

And these words which I command you today shall be in your heart.  You shall teach them diligently to your children, and shall talk of them when you sit in your house, when you walk by the way, when you lie down, and when you rise up” (Deut. 6: 6-7).

This instructs parents to teach their children God’s commands continually.

Train up a child in the way he should go, And when he is old he will not depart from it” (Prov. 22: 6).

This highlights the importance of parental instruction and its long-lasting impact.  It implicitly recognizes the vulnerability of children to outside influence.

Every person, regardless of perceived gender identity, was intentionally made by God and is valued by Him (Ps. 139: 14; Jer. 1: 5).  Gender dysphoria does not disqualify someone from God’s love.  God, however, made them male and female, with biological sex and gender linked (Gen. 1: 27).  Parents should not be penalized for teaching their children that biblical truth.

  1. It is unfathomable to me that we have reached the point where the Supreme Court has to weigh in on issues as this.

  2. Anna, another thoughtful post! It’s a strong reminder of God’s design for parents as the primary guides in their children’s lives. Your Scripture choices are spot-on. Keep shining that light!

  3. Very informative post Anna. It’s is a complex legal questions and concerns about the role of parents and schools.

  4. All of this is nothing less than the workings of Satan. He disrupted the original family in Genesis with the temptation of Adam and Eve, and he caused further erosion in the family unit when he prompted Cain to kill his own brother, Abel. After that-there has been no stopping him.

Allowing government agencies to mandate family choices and insert themselves into the child’s life in the manner described in this post leaves me to ask: are the voters in California so completely given over to sin and Satan that they have become a collective cesspool of debauchery?

The answer, of course, is that is exactly what has happened. God has been so far removed from the thinking of Californians that normal to them is anything and everything is within their rights to do.

    • You are so right, Ron.

The California law reflects the absolute faith placed in government, and the distrust of family to care for a gender dsyphoric child.

I have no doubt the law was motivated by “good intentions” which, themselves, reflect how far man can go astray when he abandons God.

The sad thing is that government is not good, holy, or omniscient the way God is. Nor does it love children the way God does.

Government is composed of fallible human beings. As such, it is prone to error; swayed by personal ambition, bias, and political pressure; subject to corruption; and characterized by bureaucratic foul-ups.

I am sure this will not be the last case challenging the family. I only pray that future decisions are as wise.

  5. Praise God for the Supreme Court’s validation of a family’s integrity and parental rights! In a world of bad news, this is good news indeed.
